Litigation is the process of taking a legal dispute to court and resolving it through a formal legal process.
Litigation is one way to resolve legal disputes, but it is not the only option. Alternative dispute resolution methods, such as mediation or arbitration, may also be used to resolve legal issues without going to court.
As litigation can be a long, complex and expensive process we prioritise attempting to resolve matters by early mediation or by correspondence. We generally are able to provide fixed fee costs for an early mediation.

If the matter cannot be resolved by agreement, then we vigorously represent our clients in the litigation process and we appear in all Western Australian Courts.

Litigation can be a long and complex process, and it may involve multiple stages, including the commencement of the action, discovery (the process of gathering and exchanging information and evidence) and trial. Depending on the nature of the dispute and the jurisdiction in which the case is being heard, the litigation process may also include appeals.

Probate Matters
​
We act in all non-contentious estate matters. In most cases to administer a deceased Estate the relevant person has to apply to the Supreme Court of Western Australia for a Court Order. This is usually called a Probate Order or Letters of Administration.
​
Often obtaining a grant of probate is a non-contentious administrative process however there are strict rules which the Court require be followed. Improperly completed applications will likely receive a requisition from the Court which can cause further delays in dealing with the Estate.

We provide a range of services from assisting with obtaining information as to the assets of the deceased and investigating the same, to filing the application and then advising as to the settlement of the Estate and administering the Estate.

Sometimes Estate disputes arise or matters become complicated by the terms of the will.
We act in all Estate dispute matters with a focus on reaching an agreed outcome. We approach these matters in a collaborative and sensitive way to try and help families to resolve issues without proceeding to Court.
